Stanford Rape Case: Brock Turner Seeks Appeal, New Trial

Brock Turner, who previous year was found guilty of sexual assault and served a three-month sentence, is appealing his conviction.

Now, however, his lawyers have launched a campaign to have those convictions overturned, filing a motion that calls his 2016 trial "a detailed and lengthy set of lies". Turner hopes that a new trial will help overturn Turner's mandatory lifetime requirement to register as a sex offender.

Brock Turner, the former Stanford swimmer and convicted rapist whose lenient sentence for sexual assault prompted national outrage, is appealing his conviction.

As previously reported, two graduate students witnessed Turner raping the unnamed woman - who was referred to as Emily Doe during the trial - in January 2015 and chased him before holding him down until police arrived.

"His conviction will be upheld", he added. "Nothing can ever roll back (the victim's) legacy of raising the world's awareness about sexual assault".

Turner's victim, styled Emily Doe in court papers, has never been publicly identified.

Key to Turner's request for a new trial is a statement the prosecutor repeatedly made during trial, saying the assault occurred "behind the dumpster".

Turner, who was a decorated swimmer at Stanford at the time, pleaded not guilty.

In the appeal, Turner's legal team claims they were at a disadvantage on three fronts: The jury did not get a lot of evidence that represented Turner's character; The jury was not allowed to consider a lesser offense; The jury was subjected to "extensive "behind-the-dumpster" propaganda".

The Standford student was found guilty of sexual assault previous year after he was accused of attacking a woman behind a dumpster while she was unconscious. Turner was released from county jail after serving three months.

Stanford law professor Michele Dauber, who is on a committee to recall the judge who sentenced Turner, said it's common for people to appeal.

His victim told the court that she had woken up hours after the attack with dried blood on her hands and no memory of meeting Turner or being taken to hospital.

If the Sixth District Court of Appeal grants Turner's request to reverse his convictions, the case would be retried in Santa Clara County and overseen by a judge other than Persky.
