Bill O'Reilly Sued for Allegedly Defaming One of His Accusers

"O'Reilly portrayed Ms. Bernstein in a false light, defamed and disparaged her character, calling into question her motives for reporting O'Reilly's abuse to HR and ultimately being forced out at Fox News with a settlement agreement", she claims in her suit.

A woman who settled with Bill O'Reilly is suing the former Fox News star and the cable network that used to employ him for defamation and breach of contract.

In a lawsuit filed Monday in U.S. District Court for the Southern District of New York, Bernstein said O'Reilly and Fox News broke their nondisclosure agreement in remarks to the New York Times.

"A History" author has time and again claimed that the harassment allegations that led to his ouster from the Fox News in April have no merit while adding that he resolved the matters privately just to protect his children. While O'Reilly has denied all sexual harassment allegations, he allegedly entered five secret settlements with victims, according to The New York Times.

Her lawsuit also claims that O'Reilly's statements that no complaints were filed against him are "deliberately misleading". Bernstein alleges that Fox News, through its parent company, 21st Century Fox, falsely told The Times that it had received no complaints to an anonymous company hotline because, she contends, there wasn't a hotline while she was employed there in 2002. She said she talked repeatedly to bosses about O'Reilly's actions, but there was no hotline in place at the time of the incidents.

Bernstein argued that all this violates the non-disparagement and confidentiality clauses in her settlement.

Subsequent statements by O'Reilly are alleged to have violated the nondisparagement clause, according to Bernstein.

In a complaint filed Monday in United States District Court for the Southern District of NY, attorneys for Rachel Witlieb Bernstein claim that O'Reilly and Fox News both broke a non-disparagement clause that was part of a 2002 settlement agreement.

O'Reilly was constrained out of Fox News in April following a progression of disclosures about affirmed lewd behavior and manhandle.

The plaintiff said she was not the source for the information printed in the Times story. The exact amount she was paid is not known, but it was far less than the other settlements.
