Kate Steinle case gunman indicted on federal weapons charges

Jurors in San Francisco Superior Court on Thursday found Garcia Zarate, 45, not guilty of murder and assault with a deadly weapon in the July 1, 2015 shooting of Steinle, a 32-year-old Pleasanton native who was killed as she walked on Pier 14 with her father.

Kate Steinle was gunned down by an illegal alien who told authorities he specifically went to San Francisco because it was a sanctuary city.

A federal grand jury has indicted the undocumented immigrant who was acquitted last week of murder and manslaughter charges in the case of Kate Steinle.

Jose Ines Garcia Zarate was indicted in by a federal grand jury on federal charges of being a felon in possession of a firearm and being an illegally present alien in possession of a firearm, according to records.

District Attorney George Gascon said Tuesday that he still believes Jose Ines Garcia Zarate should have been convicted of murder in the death of Steinle.

Defense lawyers for Garcia Zarate said Monday they will appeal the state charge for which he was convicted.

Before Steinle's death in July 2015, Garcia Zarate was deported five times; at the time of the shooting he was wanted for a sixth deportation on drug-related felonies.

A sentencing hearing is scheduled for December 14 on the firearms possession conviction, and Garcia Zarate is expected to be sentenced to either 16 months in prison, two years or three years, depending on the ruling of Judge James Feng. He said it fired accidentally when he picked it up. Garcia Zarate claimed the shooting was accidental.

President Donald Trump frequently brought up the case previous year during his presidential campaign to criticize efforts in the U.S.to combat illegal immigration.

San Francisco is one of 200 sanctuary cities around the country, so the local police don't have to cooperate with federal immigration authorities.

San Francisco prohibits city law enforcement officers from asking about immigration status or detaining people exclusively on the basis of civil immigration detainers after they are eligible for release.

Trump called the verdict "disgraceful", while Sessions said San Francisco's status as a sanctuary city was largely to blame for what happened.

President Trump has threatened to withhold federal funding from cities with similar policies.
