Judge Rules President Donald Trump Cannot Block Twitter Trolls

Trump's all-powerful Twitter reign is over

She said she assumed Trump's social media director Dan Scavino would unblock the users in light of her decision.

"Because no government official is above the law and because all government officials are presumed to follow the law once the judiciary has said what the law is, we must assume that the president and Scavino will remedy the blocking we have held to be unconstitutional", the judge wrote in her opinion.

Cohen said Trump had not yet unblocked him as of late Wednesday afternoon. Mr. Trump had tweeted, "The Justice Dept. should ask for an expedited hearing of the watered down Travel Ban before the Supreme Court - & seek much tougher version!"

The Knight Institute sued Trump last spring on behalf of seven Trump critics who had been blocked on Twitter, arguing that Trump's use of Twitter to announce policy and engage with the public constituted a public forum.

A federal judge in NY ruled Wednesday that President Trump is in violation of the Constitution when he blocks users on Twitter.

Buchwald's ruling was in response to a lawsuit filed against Trump in July by the Knight First Amendment Institute at Columbia University and several Twitter users.

However, the US Department of Justice opposed with the court decision. According to their lawsuit, because Mr Trump frequently turns to Twitter to make policy statements, his account qualifies as a public forum from which the government can not exclude people on the basis of their views.

The plaintiffs claimed in their lawsuit that by blocking users for their views, Trump was shutting them out of discussion in a public forum, violating the First Amendment.

Trump has been blocking tweets that criticize him.

"I think this decision is correct", Giampietro said. The judge agreed but said that even considering the president's First Amendment rights, preventing users from interacting directly with him on Twitter represented a violation of a "real, albeit narrow, slice of speech". "That is much less restrictive and burdensome on the plaintiffs' speech rights".

The judge's ruling noted that Trump has used his personal account, which has 52.2 million followers, to announce that the US military would not accept or allow transgender individuals to serve, that he meant to nominate Christopher Wray to head the Federal Bureau of Investigation, and that he was firing Secretary of State Rex Tillerson and Secretary of Veterans Affairs David Shulkin.

"That is insane", he said.

The White House did not immediately respond to a request for comment from Fox News. Hamza Shaban is a technology reporter for The Washington Post.
