California's 'gold standard' net neutrality becomes law

Jerry Brown has signed into law the strictest set of net neutrality protections ever seen in the US.

The U.S. Justice Department late on Sunday filed suit after California Governor Jerry Brown signed legislation to restore open internet protections known as net neutrality in the state after the Trump administration repealed the rules in December 2017.

FCC Chairman Ajit Pai, who led the effort to reverse net neutrality, said in a statement on Sunday that "not only is California's internet regulation law illegal, it also hurts consumers".

When the FCC repeated the Obama-era rules a year ago that prevented companies from exercising more control over what people watch and see on the internet, it also barred states from crafting their own rules like the California law by Democratic Sen.

U.S. Attorney General Jeff Sessions says he will defend the federal government's position.

Net neutrality prohibits the blocking of sites or services for competitive reasons, and bans "fast" and "slow" lanes for different kinds of online traffic. This means that the California state government doesn't get to pass bills that conflict directly with the ones the federal government has passed.

But with net neutrality, Martin said the FCC insists it remains the sole regulatory authority despite its deregulatory actions. A federal agency tasked with setting airline routes and fares was abolished in the 1970s, but states are still not permitted to adopt their own airline rules.

As Gizmodo reports, the bill-now the most far-reaching of its kind and considered the "gold standard" for state-level protections-"prohibits ISPs from intentionally congesting or degrading web traffic for the goal of imposing unreasonable fees on companies that connect users on ISP networks to other parts of the web, also known as interconnection".

The lawsuit argues that the Californian legislation is "unlawful and anti-consumer", as it imposes restrictions on telecommunications companies.

Regardless of the eventual outcome, Martin also believes a federal judge in California will stop the state's law from taking effect while the lawsuit remains unresolved. "When all is said and done, Comcast, Verizon, and AT&T are going to wish they'd never picked a fight with Internet over net neutrality". "Rather than 50 states stepping in with their own conflicting open internet solutions, we need Congress to step up with a national framework for the whole internet ecosystem and resolve this issue once and for all", the industry group said. These companies have not done enough to increase the number of women on their boards despite the Legislature's urging, making government intervention necessary, Jackson said. "I don't see it happening in the near future".
